Finally, the day has come when everyone will get their right to love anyone without any boundary, without any concern of getting on jail. The five Supreme Court judges declared the magnificent verdict for the gay rights movement in the country.
In 2013, the SC gave the verdict that homosexuality is an offence in India. Now the decision hve been reversed saying that it was a controversial ban made during the British-era which is irrational and arbitrary. The Chief Justice of India, Dipak Misra read, "We have to bid adieu to prejudices and empower all citizens.
Here Are The Things You Need To Know About This Big News:
1. Under the 1861 law, gay sex was an punishable offence could have landed up to 10 years in jail.
2. "Section 377" banned "carnal intercourse against the order of nature with any man, woman or animal" where homosexual sex was an offence.
3. The Chief Justice further exclaimed, "No one can escape from their individualism. Society is now better for individualism. In the present case, our deliberations will be on various spectrums."
4. The SC said, "Respect for individual choice is the essence of liberty; LGBT community possesses equal rights under the constitution".
5. This previous ban on Gay sex was challenged by five high-profile petitioners: Bharatnatyam dancer - Navtej Singh Johar, Restaurateur - Ritu Dalmia, Journalist - Sunil Mehra, Neemrana hotel chain co-founder - Aman Nath and Businesswoman - Ayesha Kapur.
6. The petitioners argued the case by saying the Section 377 contradicts the principles of the constitution on equality before law, no discrimination based on religion, race, caste, sex or place of birth and freedom of speech and expression.
The Supreme Court had had decriminalised homosexuality by overturning the outdated law and finally made our country proud and high again. This is a victorious day!
